DO YOU CHARGE SALES TAX?

 

Great question!  No, and here’s why:

 

In states where DJ/MC services are recognized as a taxable service, a DJ company will most likely charge you sales tax if their business is a legal entity (a sole proprietorship, LLC, or corporation) and if they carry a state Sales Tax Permit.

 

Texas, however, does not recognize DJ/MC services as a taxable service.  

 

In Texas, the category of “amusement services” is recognized as a taxable service, but per the Tax Code Section 151.0101, Comptroller Rule 3.298, the entertainment provider must be selling admissions to the event.  This would be something like purchasing a ticket for a one-night concert event and paying sales tax on the cost of that ticket.

 

So if you receive a quote from a DJ company who mentions sales tax, do yourself a favor and ask to see a copy of their Texas Sales Tax Permit.  If they cannot provide, then they have no legal right to charge you a sales tax.
